Default Creating Linux-Swap Partition

I am trying to create a swap partition and it's not letting me.. I can create an ext2 etc.. but not swap partitions. It's giving me this error details:
Code:
GParted 0.3.3

 Libparted 1.8.8

Create Primary Partition #1 (linux-swap, 1004.06 MiB) on /dev/sda 00:01 ( ERROR )

   create empty partition 00:00 ( SUCCES )

  path: /dev/sda1
start: 63
end: 2040254
size: 2040192 (996.19 MiB)
   set partitiontype on /dev/sda1 00:01 ( SUCCES )

  new partitiontype: linux-swap
   create new linux-swap filesystem 00:00 ( ERROR )

  mkswap /dev/sda1

  /dev/sda1: Device or resource busy

  ========================================
And in Konsole it's showing
Code:
Can't have a partition outside the disk!

The first partition, sda1, is usually your Linux or Windows partition. Is this a secondary HD?

No, sda1 is empty right now. I had the windows recovery partition, but as I have a recovery DVD, I just deleted that partition, now I have like 1GB with no use.. so, my Sabayon installation doesn't have a swap partition and it's running quite slow... So I thought, why not using sda1 as a linux-swap partition?

But it won't let me!!

You have to format it as a swap partition first. Did you do that?

I find GParted very unstable! It crashes nearly after every action that it does.
